Volkswagen & Audi “Clean Diesel” Scandal

In mid-September of 2015, Martin Winterkorn, Chief Executive Officer of Volkswagen AG, resigned amid news of a major scandal concerning the emission standards of several models of vehicles with so-called “clean diesel” engines.

So far, the company has admitted that it installed “defeat devices” in certain vehicles with diesel engines manufactured between 2008 and 2015. These devices, which could detect when the vehicle was being tested and modify the way the engines run, essentially helped the vehicle cheat its way through air emission tests by disguising the amount of emissions the vehicle would actually release under regular driving conditions.

Vehicles that received satisfactory test results were, in reality, releasing 10 to 40 times more pollutants than the legal limit outlined by the Environmental Protection Agency (EPA).

As many as 11 million diesel engine vehicles worldwide are said to contain the defeat device. Volkswagen is facing penalties of up to $37,500 per vehicle, totaling a massive $18 billion in fines.

Pursuant to the EPA’s Clean Air Act, Volkswagen will likely face criminal prosecution for tampering with air emissions monitoring devices, as well as for making false statements about their vehicles to the EPA and to consumers. The U.S. Department of Justice has launched a criminal inquiry, and other countries around the world have begun performing their own investigations.

Impending Lawsuits for Volkswagen’s “Diesel Dupe”

People who purchased an allegedly “clean-diesel” vehicle are understandably upset that Volkswagen has lied to them. The EPA plans to force Volkswagen to recall all affected models in the U.S., including:
